The personal data that we collect may vary based on the interaction by the individual customer or visitor with our digital presence (website, SaaS or social media applications) and requests for our services. For instance, when you follow or subscribe to our site on a social media application, to ensure the security and appropriateness of our services we will process the data you provide, including account information, nickname or avatar. Personal data does not include data that is encoded, anonymized, aggregated, or publicly available data that has not been combined with non-public personal data.

However, if you have questions for an Uniking Canada representative or request a quote, we ask for your personal data so that we can respond directly to your inquiry. If the Company intends to use personal data submitted by individuals for reasons that are not consistent with the above, the affected individual will be given the opportunity to opt-in or out of that use or transfer.

Shipping Terms and Conditions


All freight estimates are just that‐ “estimates” and can vary widely until they are billed. All extra costs beyond the freight estimate will be billed to the buyer, and payment will be expected within normal terms and conditions. The buyer is 100% responsible to cover any of these additional costs. Shipping method is determined by the size and weight of each item and delivery speed you request. Items of differing size and weight may ship independently, by different methods, even if ordered together. Most smaller items will be sent via Courier Small Packaging. Items that are too large or too heavy will be sent by LTL common carriers.

Estimated Shipping/Freight charges are calculated based on the estimated weight, size of item/packages, and distance traveled and type of shipping service you specify (ground, next day, second day, LTL, or Truckload).

All Freight shipments (including prepaid, collect, and third party) are based on standard truck delivery to a dock facility designed to receive freight. All other fees are not added unless expressly requested by you and confirmed in writing by seller to you. Those additional fees include but are not limited to Twenty‐four‐hour notification, special delivery times, residential deliveries, lift gate requirements, and/or inside deliveries. If additional fees are incurred while in transit or while being delivered, the buyer will be 100% responsible for the additional costs associated with the shipment. In addition, seller is not responsible for additional charges due to detention for slow unloading (more than 45 minutes) of tractor trailers at buyers’ site, or other special machinery or equipment to unload the freight once it arrives. In addition, there may be a variance in fuel surcharge costs from date of original quote to actual ship date, or world/annual events which cause truckload rates to fluctuate.

Buyer or buyer’s agent must be present to accept truck deliveries and sign for the products received. A signature will be required for all shipments to make sure that all goods were delivered as specified on the bill of lading. It is buyer’s responsibility to note any damages and/or shortages of freight on carrier’s delivery paperwork. If seller shipped the products ‘Prepaid’, it is buyer’s responsibility to notify seller within 24 hours so that seller may begin a freight claim and replacement order. For other than ‘Prepaid’ shipments, it is buyer’s responsibility to file damage and/or shortage claims directly with the carrier. Unless otherwise stated, freight and shipping fees will be charged for shipments to anywhere globally using a carrier of our choice. Seller normally picks the most economical choice based on cost, service, and reliability; however, other circumstances may require us to ship with a different carrier or method. Any special request by the customer must be made when the freight quote request is made, and/or when the order is placed with seller.

Any extra charges incurred for additional services,such as customer's carrier or special handling by the carrier, must be paid by the buyer.




Terms and conditions


Terms and Conditions of Sale


These terms and conditions, along with the accompanying quotation or acknowledgment and all documents referred to specifically, will be the sole and complete statement of the agreement governing the sale of the product by Uniking Canada Inc. (The Seller) to the consumer (the Buyer). The acceptance of the product by the Buyer will serve as evidence of their consent to these terms and conditions. If these terms and conditions differ in any way from the requirements of the Buyer's order or any other document, this document from the Seller will be interpreted as a counteroffer replacing the Buyer's requirements and will not be considered an approval of the Buyer's requirements that may conflict with the document from the Seller. No merchandise can be returned by the Buyer to the Seller without the issuance of a return authorization number by the Seller. The Seller reserves the right to refuse all returns of goods if they are not an off-the-shelf item. Transportation costs and any other return fees will be at the expense of the Buyer.


Warranty and Liability Limits


The Seller warrants the product to be free from material and manufacturing defects when properly installed, regularly maintained, used normally, and not modified by the Buyer. This warranty is valid for a period of 30 days (unless otherwise specified in writing by the Seller) from the date of product shipment by the Seller. This is the sole and exclusive warranty provided by the Seller for the product and replaces and excludes all other warranties, whether mentioned or implied, that may arise by operation of law or otherwise. This includes, without limitation, warranties of merchantability or fitness for a particular purpose, whether or not the purpose or use has been disclosed to the Seller in specifications, drawings, or otherwise. It also applies whether or not the Seller's products are specifically designed and manufactured for the Buyer's use or purpose.

The Seller's only obligation under this warranty is to repair or replace, as applicable, the defective product or part of the product returned by the Buyer. Transportation costs will be reimbursed by the Seller during the warranty period mentioned above when the Seller's examination of the product demonstrates that there is indeed a defect in the said product. This warranty does not apply to the product or part of the product that results from a defect or damage caused by improper installation, abnormal use, an accident, abuse, negligence, unauthorized modification or alteration, use beyond the capacities and conditions permitted or specified in the catalog or other provided documents, or inadequate maintenance of the product. Furthermore, any defects discovered by the Buyer must be reported in writing to the Seller within thirty days following the shipment date of the said product. The repaired or replaced product during the warranty period will be covered by the current warranty until the end of the original warranty or for a period of thirty days, whichever is longer. The Buyer's failure to provide written notice within the applicable time period will be deemed an irrevocable and unconditional waiver of the Buyer's claim for such defects.

The remedy covered by this warranty applies solely between the Buyer and the Seller and excludes any other person or entity that may purchase, acquire, or use the Seller's product. The Seller's liability is strictly limited to the replacement of the defective product or part of the product, and the Buyer waives all other remedies, including but not limited to any rights regarding direct, special, or indirect damages, including but not limited to damages resulting from personal injury, death, or damage to or loss of use of property or equipment. It is also expressly understood that any technical advice provided by the Seller regarding the use of the product is given without charge, and the Seller assumes no obligation or liability regarding the advice provided or the results obtained, and all such advice is given and accepted at the risk of the Buyer.


Consideration of Product Use


The proper selection and actual use of products, including product safety related thereto, remains the responsibility of the Buyer/user. Operating and performance requirements and potential outcomes will vary significantly depending on the specific use and application of the products. The scope of technical information and usage criteria included in the catalog is necessarily limited. Inappropriate operating environments, inadequate lubrication requirements, and other factors can materially affect the operating results and performance of the products, and the Buyer/user should carefully review their requirements. Any technical advice or comparison provided by the Seller regarding product use is given in good faith and without charge, and the Seller assumes no obligation or liability for the advice given or the results obtained, all such advice or comparisons being given and accepted at the risk of the Buyer/user.

Reservation of Ownership: We reserve ownership of the goods sold until the last day of their perfect payment.

Exclusions, Damages: We shall not be held responsible for loss of production, loss of use, or any other direct or indirect economic damage, whatever it may be.


Standard terms and conditions of sale


These terms and conditions, the attendant quotation or acknowledgement and all docements incorporated by specific reference there in, will be complete and exclusive statement of the agreement governing the sale of goods (GOODS) by Uniking Canada inc. (SELLER) to customer (BUYER). Buyer’s acceptance of the goods will manifest buyer’s assent to these terms and conditions. If these terms and conditions differ in any way from requirements of buyer’s order, or other documentation, this document will construed as a counteroffer and will not be deemed an acceptance of buyer’s requirements which conflict herewith. No merchandise can be returned by the buyer to the seller without a written authorisation by the seller. Any merchandise which is not standard or commodity shelf product and had to be manufactured for the buyer is not returnable. Any fees regarding the acceptation by the seller to the buyer concerning the return of merchandise will be the responsibility of the buyer.


Warranty and limitation of liability


Seller warrants that the goods will be free from defects in material and workmanship under proper installation (along instructions provided by seller), regular maintenance, normal use and without having been modified by buyer, and this for a period of 30 days (unless otherwise specified by seller in writing) from the date of shipment of the goods by seller. This is the sole and exclusive warranty given by seller with respect to the goods and is in lieu of and excludes all other warranties, express or implied, arising by operation of law or otherwise, including without limitation, merchantability or fitness for a particular purpose whether or not the purpose or use has been disclosed to seller in specifications, drawings or otherwise, and whether or not seller’s products are specifically designed and / or manufactured by seller for buyer’s use or purpose.

Seller’s sole obligation under this warranty shall be to repair or replace any defective product or part of the product which is returned. Transportation will be paid within the warranty period mentioned above where examination of the product by seller proves to seller’s satisfaction that the product or part of the product is defective. This warranty shall not apply to any product or part of a product which as been subjected to improper installation and maintenance, misuse, neglect, accident, abuse, unauthorised modification or alternation, or used beyond rated capacity and conditions specified in the catalogue or other documents. Furthermore, any warrant y defects discovered by buyer within warranty period mentioned above must be notified in writing to seller within thirty days after expedition of the goods. Goods replaced or repaired during the warranty period shall be covered by the foregoing warranty for the remainder of the original warranty period or thirt y days, whichever is longer. Failure by buyer to give such written within the applicable time period shall be deemed an absolute and unconditional waiver of buyer’s claim for such defects.

Remedy under this warranty is between buyer and seller only and no other person or entity who may buy, acquire or use seller's ’goods. Seller’s liability is only limited to the replacement of the defective product or part of product and buyer waives all other remedies, including but not limited to damages resulting from personal injury, death or damage to or loss of use of property. It is expressly understood that any technical advice furnished by seller with respect to the use to the goods is given without charge, and seller assumes no obligation or liability for the advice given or results obtained, all such advice being given and accepted at buyer’s risk.


Application considerations of products


The prosper selection and application of products, including the related area of product safety, is the responsibility of the buyer. Operating and performance requirements and potential associated issues will vary appreciably depending upon the use and application of such products. The scope of the technical and application information included in this catalogue is necessarily limited. Unusual operating environments and conditions, lubrication requirements, and other factors can materially affect the application and operating results of the products and the buyer should carefully review its requirements. Any technical charge and seller assumes no obligation or liability for the advice given, or results obtained, all such advice and review being given and accepted at buyer’s risk.

Expedition of merchandise: The Company will remain the ownership of all delivered merchandise until final payment is received and cashed.

Exclusions, damages: We are not responsible for any lost of production, usage or any direct or indirect economical damages.
